General Counsel

As the General Counsel, you provide senior management with effective advice on company strategies and their implementation, manages the legal function, and obtains and oversees the work of outside counsel. The General Counsel is directly involved in complex business transactions in negotiating critical contracts.

The General Counsel’s responsibilities span across all aspects of GHP business and include the following areas of practice: Landlord Tenant, Corporate & Contracts Law, General Liability and Employment Law through the execution of related activities and the supervision both internal legal staff and outside counsel and law firms.

ROLE DESCRIPTION:

As the General Counsel, you provide senior management with effective advice on company strategies and their implementation, manages the legal function, and obtains and oversees the work of outside counsel. The General Counselis directly involved in complex business transactions in negotiating critical contracts.

The General Counsel’sresponsibilities span across all aspects of GHP business and include the following areas of practice: Landlord Tenant, Corporate & Contracts Law, General Liability and Employment Law through the execution of related activities and the supervision both internal legal staff and outside counsel and law firms.

REPORTS TO:VP of OPERATIONS

  • Landlord Tenant:
  • Oversees the preparation of correspondence related to eviction and as necessary composes directly.
  • Oversees the application process and approval related to service animals/pets and reasonable accommodation requests
  • Where outside counsel is not necessary, handles all Fair Housing and Housing Authority Claims
  • Works with Regional Managers and Community Managers on resident situations to avoid legal escalation
  • Works closely with Community staff on any problem residents and other major issues which arise.

Corporate Legal:

  • Reviews and or prepares as necessary all corporate policies.
  • As necessary advises the Director of Operations with legal questions regarding receivables and policies
  • Reviews and advises on all GHP lease changes or any other regulatory changes
  • Reviews all GHP notices to ensure up to date and current requirements (PQ & other legal)
  • Reviews, revises and drafts necessary covenants.
  • Steps in to enforce contracts and where necessary negotiates on behalf of GHP to terminate contracts.
  • Works with City of Los Angeles, Montclair and Santa Clarita regarding property related notices received (if necessary)
  • Works with large vendors such as AT&T, TW, and Aerio to ensure the best rate per door, 2. And ensure contracts are designed favorably to GHP Management
  • As necessary works closely with other subsidiaries on planning and housing legal issues.
  • Prepares all housing license agreements and ensures these are up to date.
  • Trains our staff on legal issues and how to handle different situations

General Liability:

  • Oversees and supervises legal staff and as necessary addresses claims both small and large.
  • Prepares all discovery for claims
  • Where necessary acts as primary negotiator for claims.
  • Attends depositions in representation of GHP
  • Acts as first point of contact and liaison on behalf of GHP for all claims insurance adjustors and their respective attorneys
  • Oversees all major fire and floods, claims
  • Supervises and where necessary handles all our Mold cases with residents and their attorney
  • Walks the properties with our insurance broker to ask risks and prepare risk management strategies

Employment

  • Acts as legal consultant to the HR department on escalated employee relations issues conferring on strategy for issue resolution and assessing the legal risk and exposure.
  • Acts as first point of contact with outside counsel on employment legal issues.
  • Works closely with HR Director on Workers Compensation matters including risk management, settlements, and claims and strategy.

PROFESSIONAL REQUIREMENTS

  • Minimum B.A. Degree Law and JD in Law minimum required
  • 5-7 years’ experience in corporate law within a real estate & property management industry

PHYSICAL REQUIREMENTS

  • Must be able to regularly travel to multiple property locations daily/weekly/monthly within assigned portfolio as well as company meetings and conferences which may include air travel.
  • Frequently move/traverse, ascend/descend stairs in/around apartment homes and community
  • Constantly positions self to bend, stoop, reach, lift
  • Occasionally lift/move/carry up to 25lbs with/without assistance
  • Frequently lift/move/carry 5lbs
  • Constantly communicate, converse and exchange information with coworkers, vendors, residents and visitors
  • Ability to remain in a stationary position for extended periods of time
  • Ability to observe details at close range (within a few feet of the observer).
  • Constantly operates computer, 10-key and other office productivity machinery.
  • Constantly works in low to moderate noise levels
  • Constantly works in outdoor weather conditions
